These Terms & Conditions (“Terms”) govern your access to and use of Diginou (the “Platform”), operated by Diginou (“we”, “us”, “our”), accessible via https://diginou.com and through any associated software, services, or applications (collectively, the “Service”).

By accessing or using any part of the Diginou platform, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Diginou provides restaurant owners and food businesses with digital tools to create and manage online menus, process and manage orders, and other related business operations.

The Platform may include, but is not limited to:

  • Menu creation and editing

  • Order management tools

  • Customer interaction features

  • Reporting dashboards

  • Integration options (POS systems, websites, social media, etc.)

2. User Eligibility

You must be at least 18 years of age and legally able to enter into binding contracts to use this platform. By using Diginou, you confirm that you meet these criteria.

3. Account Registration

To access most features, you must register and maintain an active account. You are responsible for:

  • Providing accurate, up-to-date information

  • Maintaining the confidentiality of your account credentials

  • All activity under your account

We reserve the right to suspend or delete accounts at our discretion.

4. Acceptable Use

You agree not to:

  • Use the platform for any illegal or unauthorized purpose

  • Copy, modify, distribute, or reverse-engineer any part of the platform

  • Upload harmful code or violate platform security

  • Infringe on intellectual property rights of Diginou or others

  • Use the service to store or transmit libelous, obscene, fraudulent, or otherwise unlawful content

5. User-Generated Content

You retain ownership of the content you upload (menus, product descriptions, images, etc.). However, by uploading it, you grant Diginou a non-exclusive, worldwide, royalty-free license to use, host, reproduce, and display that content only for the purpose of operating and promoting the Service.

You are solely responsible for your content. Diginou is not responsible for any inaccuracies, legal issues, or damages resulting from user-generated content.

6. Third-Party Integrations

The platform may integrate with third-party services (e.g., payment processors, delivery platforms, POS systems). Your use of those services is subject to their own terms and privacy policies. Diginou is not responsible for issues or losses related to third-party services.

7. Availability and Support

While we aim for continuous uptime, we do not guarantee availability or uninterrupted access. We may update, suspend, or discontinue parts or all of the Service at any time without notice.

We offer support on a best-effort basis and make no guarantees regarding response times or issue resolution.

8. Limitation of Liability

To the fullest extent permitted by law:

  • Diginou shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or related to your use or inability to use the platform.

  • Our total liability, for any claim, shall not exceed the amount paid by you (if any) for the use of our Service in the 3 months preceding the claim.

You use the platform at your own risk. All services are provided “as is” and “as available”, without any warranties of any kind, express or implied.

9. Indemnification

You agree to indemnify, defend, and hold harmless Diginou and its affiliates, officers, directors, and employees from any claim, liability, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or your infringement of any third-party rights.

10. Intellectual Property

All content, trademarks, code, and features provided by Diginou (excluding user content) are the intellectual property of Diginou. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.

11. Termination

We reserve the right to terminate or suspend your account at any time, without notice, if you violate these Terms or if we suspect misuse.

You may stop using the service at any time. Any outstanding fees or obligations will still be enforceable.

12. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted under the laws of Greece. Any disputes shall be resolved in the courts of Athens.

13. Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page and become effective immediately. Continued use of the platform constitutes your acceptance of the revised Terms.

14. Pricing and Modifications

Diginou reserves the right to change the pricing of its services at any time, at its sole discretion and without liability. Any changes to pricing will be communicated via the platform or email and will take effect immediately unless otherwise stated. Continued use of the Service after a price change constitutes your acceptance of the new pricing. You are responsible for reviewing and understanding the current pricing before continuing to use the Service.
